These Terms & Conditions apply to your use of our website and to purchases made from Elvigo Fashion online, in-store, or through direct communication, including email, phone, and social media.

By accessing our website or placing an order with us, you agree to these Terms & Conditions together with our Privacy Policy, Shipping Policy, and any other policies referenced on this website.

In these Terms & Conditions, we, us, and our refer to Elvigo Fashion. You and your refer to any customer, website user, or purchaser.

2. Use of This Website

This website is provided for general information and shopping purposes.

We aim to keep all information on the site accurate and up to date, however we do not guarantee that all content is always complete, current, or free from errors.

All content on this website, including images, branding, logos, design, text, product descriptions, layout, and graphics, is owned by or licensed to Elvigo Fashion and may not be copied, reproduced, distributed, or used without prior written permission.

Unauthorised use of this website may result in restricted access, legal action, or both.

3. Orders and Order Acceptance

Orders may be placed through our website, in-store, or through direct communication with our team, including social media.

Placing an order does not automatically mean that the order has been accepted.

All orders are subject to availability, confirmation of pricing, and payment approval. We reserve the right to refuse, cancel, or limit any order at our discretion, including where there is a pricing error, stock issue, suspected fraud, or incorrect product information.

Orders are considered confirmed once full payment has been received, unless otherwise agreed by us in writing.

4. Pricing and Payment

All prices displayed on our website are in Australian Dollars (AUD) and include GST where applicable.

Prices may change prior to purchase without notice. The price payable for your order is the price displayed at the time the order is placed, unless there has been an obvious pricing error.

Full payment must be received before an order is processed, dispatched, or moved into production, unless a layby or payment arrangement has been agreed in advance.

For international orders, where accepted, you are responsible for any applicable shipping charges, customs duties, taxes, or import fees.

5. Product Information and Availability

We make every effort to display our products as accurately as possible.

However, colours, fabrics, finishes, embellishments, and other details may vary slightly due to screen settings, photography, lighting, production batches, and the handcrafted nature of some garments.

Product availability may change without notice. In some cases, an item shown online may no longer be available, may be available only by special order, or may differ slightly from previous samples or images.

6. Custom-Made, Made-to-Order and Production Timeframes

Custom-made and made-to-order dresses require production time.

Unless otherwise stated, the standard production timeframe for custom-made dresses is a minimum of 12 weeks, unless the item is already in stock.

Rush orders may be available at an additional cost, subject to approval, fabric availability, production capacity, and delivery timing.

Production and delivery timeframes are estimates only and may be affected by supplier delays, fabric availability, courier delays, peak periods, or circumstances outside our control.

It is your responsibility to place your order with sufficient time before your event. We are not responsible for orders placed too close to the required wear date where timing has not been confirmed in advance.

7. Measurements, Sizing and Alterations

You are responsible for providing accurate measurements and selecting the most suitable size when ordering.

We are not liable for sizing issues caused by incorrect measurements, changes in body shape or size after ordering, or size selections made without checking the relevant size guidance.

Alterations are not included unless clearly stated otherwise.

Where sizing advice is provided, this is intended as general guidance only and does not guarantee an exact fit.

8. Shipping and Delivery

Shipping and delivery terms are set out in more detail in our Shipping Policy.

Where shipping is offered within Australia, any applicable shipping terms, costs, or inclusions will be shown on the relevant product page, at checkout, or otherwise advised by us.

Delivery timeframes are estimates only. We are not responsible for delays caused by couriers, public holidays, weather events, customs processing, incorrect delivery details, or other events outside our control.

You are responsible for ensuring that your shipping details are complete and accurate at the time of purchase.

9. Showroom Appointments

Our showroom operates by appointment only.

Showroom appointments are intended for selected premium styles, fittings, and limited hire or purchase enquiries. Not all styles shown online will be available to try on in the showroom.

Appointment availability is subject to confirmation. Booking an appointment does not guarantee that a particular dress, size, or style will be available unless we have confirmed this with you in advance.

10. Change of Mind, Returns and Exchanges

Because many of our garments are occasionwear, and some items are custom-made, made-to-order, or specially sourced, change-of-mind returns are not automatically available on all purchases.

Custom-made, made-to-order, altered, and specially sourced items are generally non-refundable for change of mind.

For eligible standard-size items, we may offer an exchange or store credit where the item is returned:

  • within 3 business days of delivery
  • unworn, unaltered, and unused
  • in original condition
  • with all tags attached
  • free from makeup, perfume, marks, damage, or other signs of wear

Any approved exchange or store credit is subject to inspection and approval by Elvigo Fashion.

Unless otherwise stated, return shipping costs for change-of-mind returns are your responsibility.

Sale items, custom-made garments, altered items, and special-order items may be excluded from exchange or store credit.

11. Faulty, Damaged or Incorrect Goods

If you receive an item that is faulty, damaged, or incorrect, please contact us as soon as reasonably possible after delivery.

We may ask you to provide photographs and other details so we can assess the issue.

Where a product does not meet a consumer guarantee under Australian Consumer Law, you may be entitled to a repair, replacement, refund, or other remedy depending on the nature of the issue.

Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies you may have under Australian Consumer Law.

12. Layby and Payment Plans

Where layby or a payment plan is offered, a $50 non-refundable deposit is required unless otherwise agreed.

Payment schedules are arranged individually and must be completed within the agreed timeframe.

Late payments may result in delays, cancellation of the arrangement, additional fees where permitted, or loss of the item being held.

Orders under layby or payment plan arrangements will only proceed to dispatch or final release once full payment has been received.

13. Limitation of Liability

To the extent permitted by law, Elvigo Fashion is not liable for any indirect, incidental, special, or consequential loss arising from the use of our website, the purchase of our products, delays outside our control, or the misuse of goods after delivery.

Nothing in these Terms & Conditions excludes liability that cannot lawfully be excluded.

14. Privacy

Your use of this website and any purchase made through it is also subject to our Privacy Policy.

By using this website or placing an order, you agree that we may collect, use, and store your information in accordance with our Privacy Policy for the purposes of processing orders, providing customer support, and communicating with you.

15. Changes to These Terms

We reserve the right to update or amend these Terms & Conditions at any time.
